Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) form a binding agreement between you and Pokky Game (“we”, “us”) covering your access to and use of pokkygame.com and every game, page and feature on it (together, the “Service”).

By visiting the Service or playing any game on it, you confirm that you have read these Terms and agree to be bound by them, together with our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, please do not use the Service.

2. Eligibility and age

The Service is a general-audience website. You may use it if you are able to form a binding contract under the laws of your country. If you are a minor, you may use the Service only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.

We do not knowingly collect personal information from children under 13. If you are a parent or guardian and have a concern, see our Privacy Policy.

3. Your licence to use the Service

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access the Service and play its games for your own private, non-commercial entertainment.

This licence does not permit you to:

• Copy, download, redistribute, sell, licence or commercially exploit any game or other material from the Service.
• Host, embed, mirror or reframe any game on another website, application or platform without our prior written permission.
• Modify, decompile, disassemble or reverse-engineer any part of the Service, except to the extent that applicable law expressly permits it.
• Remove, obscure or alter any copyright, trademark or other proprietary notice.
• Use the Service to build, train or evaluate a competing product, dataset or model.

4. Acceptable use

You agree not to do any of the following, and not to help anyone else do them:

• Interfere with, disrupt or place an unreasonable load on the Service or the networks and servers that deliver it.
• Attempt to gain unauthorised access to any part of the Service, or to any account, system or data connected to it.
• Probe, scan or test the vulnerability of the Service, or breach or circumvent any security or authentication measure.
• Use bots, scrapers, crawlers or other automated means to access the Service, except for search-engine crawlers that respect our robots.txt.
• Manipulate scores, leaderboards or play counts, or introduce malware, cheats or other harmful code.
• Generate artificial advertising impressions or clicks, or encourage others to do so.
• Use the Service in a way that breaks any applicable law or infringes anyone else's rights.

We may investigate suspected breaches and take any action we consider appropriate, including blocking access and reporting the matter to the relevant authorities.

5. Intellectual property

Our content

The games we build, together with the Site’s source code, artwork, layout, text and the Pokky Game name and logo, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any ownership to you.

Third-party rights

Some games on the Service belong to genres popularised by well-known titles. Those games are independent works: we build our own mechanics, code and artwork, and we do not reproduce the characters, logos, level designs or branding of any other publisher. All third-party names and trademarks that may appear on the Service remain the property of their respective owners, and their use does not imply any affiliation with or endorsement by them.

If you believe your rights are infringed

We take copyright seriously and respond to properly submitted notices. Please follow the procedure set out in our DMCA and Copyright Policy, or write to dmca@pokkygame.com.

6. Advertising

The Service is provided free of charge and is funded by advertising. Advertisements are selected and served by third-party advertising partners, and their presence on a page is not an endorsement by us of the advertiser, its products or its claims.

Any dealings you have with an advertiser — including purchases, correspondence and the terms on which those are conducted — are solely between you and that advertiser. We are not a party to them and are not responsible for any loss arising from them.

You must not interfere with the display of advertising, nor generate invalid impressions or clicks. Doing so may constitute fraud against the advertising network and will result in your access being blocked.

7. Availability and changes

We aim to keep the Service available and working, but we do not guarantee uninterrupted access. We may add, change, suspend, restrict or remove any part of the Service — including individual games — at any time and without notice, for reasons including maintenance, technical problems, legal requirements or a decision to retire a feature.

Game progress is stored in your own browser. Clearing your browser data, switching browsers or using private browsing will lose that progress, and we cannot restore it.

8. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from a course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits any right you have as a consumer that cannot be limited by law.

9. Limitation of liability

To the fullest extent permitted by law, neither we nor our officers, employees or suppliers will be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service — whether the claim is based in contract, tort, negligence, strict liability or otherwise, and even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Service will not exceed one thousand Indian rupees (₹1,000) or the amount you have paid us in the twelve months preceding the claim, whichever is greater. As the Service is free, that amount is normally nil.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

10. Indemnity

You agree to indemnify and hold harmless Pokky Game and its officers, employees and suppliers from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or of the rights of a third party.

11. Third-party links and services

The Service contains links to websites and resources we do not control, including those reached through advertisements. We provide those links for convenience only. We do not endorse and are not responsible for the content, policies or practices of any third-party site, and your use of them is governed by their terms, not ours. See our Disclaimer for more.

12. Suspension and termination

We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have breached these Terms or that your use poses a risk to the Service or to other users. You may stop using the Service at any time. Sections that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, indemnity and governing law — will continue to apply.

13. Governing law and disputes

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with Indian law, without regard to its conflict-of-laws rules.

You and we agree that the courts of India will have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts, this clause does not remove that right.

Before starting formal proceedings, we ask that you contact us at legal@pokkygame.com so that we can try to resolve the matter directly. Most issues are settled quickly this way.

14. General terms

• Entire agreement. These Terms, with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service.
• Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign or transfer these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets.
• Changes. We may revise these Terms from time to time. The revised version takes effect when posted, and we will update the “Last updated” date. Continuing to use the Service after that means you accept the change.
